Welcome to DLG Arts! Our services and products are provided subject to the following terms and conditions. By using the website, you agree to be bound by these terms and conditions. We do not accept responsibility that the website, its servers, or e-mail sent from the website are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of the website, including, but not limited to direct, indirect, incidental, punitive or consequential damages. Certain laws do not allow limitations as contained in this clause. If these laws apply, some or all of the above limitations may not apply to you and you might have additional rights. We do not accept responsibility for any viruses or other harmful components that occur during the interaction with any of our services via upload or download.

III. Terms of Sale

These Terms of Sale apply to all offers made by DLG Arts all purchases and orders placed by you and all agreements concluded between us in relation to the products and services offered on this website.

Return Rights

We are committed to quality products and your satisfaction is 100% guaranteed.

If for any reason you are not completely satisfied with your printed purchase, you may return it within 30 days of receipt and receive a free replacement or a full refund for the price of the product. Shipping charges will not be refunded.

If your order should arrive in less than satisfactory condition, an email and send to info@dlgarts.com. Please include in the body of the email: your order number, the shipping ID or item number, a brief description of the reason for the return, and let us know whether you are seeking a replacement or a refund. Requests are usually processed within 48 hours and you will receive an email letting you know your replacement is under production or your refund is being processed.

To return your item(s) please pack them in the original packaging and include the completed Return Instructions form which you will find on the back of the Packing List included with your order. Be sure to specify the reason for the return and what action you would like us to take: replacement or refund. We strongly encourage you to return your item via a trackable method.

Custom digital artworks cannot be returned and all sales are final once the project is completed.

Acceptance of Order

We reserve the right to refuse or cancel any order. In such an event your sole recourse shall be the return of amounts paid by you related to such order (if any).

Sales Tax

Items shipped to destinations in the states of Alabama, California, Colorado, Connecticut, Hawaii, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, New York, North Carolina, North Dakota, Oklahoma, Pennsylvania, Rhode Island, South Dakota, Tennessee, Vermont, Washington, Wisconsin, and Ohio are subject to tax.

Disclaimer

We are not liable for any financial damage (including but not limited to the cost of any replacement purchase) that may occur because of non-timely arrival or any lack of availability or conformity of the product.

Printing Services, User Generated Content, and Submissions

With some of our services, we may offer a service that allows you to upload images, photographs, graphic designs, and other content (collectively, "User Generated Content") to the Website to create, produce, and purchase Products featuring the uploaded Content for your own use ("Printing Service").

If you wish to use the Printing Service, you will upload or deliver to us all User Generated Content that you want to use with the service in accordance with the applicable instructions on the Website. We may, in our sole and exclusive discretion, determine whether any User Generated Content complies with such instructions and is satisfactory for use with the Printing Service.

You will retain ownership of the User Generated Content that you upload to the Website. You hereby grant to us a royalty-free, worldwide, transferable, non-exclusive, sublicensable, right and license to use such User Generated Content, in all media existing now or created in the future, as we deem necessary to enable you to fully use the Printing Service and for us to provide the Printing Service. We may sublicense the rights that you grant to us in this Section to a third party subcontractor for any appropriate purpose including, but not limited to, providing the Printing Service, processing your order, and producing and shipping your Products.

As a part of our Services, you may have the option of creating a gallery of your User Generated Content ("Gallery"). You are responsible for all the content in your Gallery. You understand and agree that we shall not be liable for any access to, use of or disclosure of any User Generated Content, including images, comments or other content in your Gallery. We may require you to change the URL for your Gallery.

You agree not to provide any User Generated Content, comments, ideas, suggestions, information, files, videos, images, or other materials that (i) is defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior, (ii) violates or infringes the privacy, copyright, trademark, trade dress, trade secrets, or intellectual property rights of any person or entity, or (iii) contains or transmits a virus or any other harmful component. You represent and warrant to us that you have the legal right and authorization to provide all User Generated Content, comments, ideas, suggestions, information, files, videos, images, and any other materials to us for the purpose and use as set forth herein. You agree not to contact other users of the Website through unsolicited e-mail, telephone calls, mailings, or any other method of communication.

You grant DLG Arts LLC the right to use the name that you submit in connection with any User Generated Content. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any User Generated Content. You are and shall remain solely responsible for the content of any User Generated Content you make. DLG Arts LLC and its affiliates take no responsibility and assume no liability for any User Generated Content submitted by you or any third party.

All brand, product, and service names used on the Website which identify us or other third parties and their products are the proprietary marks of DLG Arts LLC and/or the relevant third parties. Nothing in these Terms shall be deemed to confer on any person any license or right on the part of DLG Arts LLC or any third party with respect to any such image, logo, or name. You shall not make any use of any DLG Arts LLC trademarks, logos, or trade dress without our prior express and written approval.

All User-Generated Content and other materials are subject to review and examination by us. Any and all images are subject to all applicable laws, and any perceived violations of law will be reported by us to the applicable law enforcement authorities. We reserve the right in our sole and absolute discretion to refuse to process or post any User Generated Content and other materials that we deem objectionable.
